Applicability of the Agreement

This User Agreement governs the terms and conditions under which Tripiy Holidays Pvt. Ltd. (hereinafter referred to as "THPL"), operating under its brand "Tripiy," provides services to Users. "User" refers to any person(s) engaging with THPL through its website, mobile application, sales representatives, offices, call centers, advertisements, or any other customer interface channels. Each Party to this Agreement, THPL and the User, is individually referred to as a "Party" and collectively as the "Parties." By engaging with THPL, the User acknowledges and agrees to be bound by the terms herein.

User Responsibility for Awareness and Acceptance

By utilizing THPL's services, the User confirms they have thoroughly read, understood, and expressly agreed to all terms, conditions, and notices within this Agreement. These terms shall govern all transactions with THPL and supersede any conflicting terms in any ancillary agreements unless explicitly stated otherwise. THPL reserves the right, at its sole discretion, to terminate access to its services or platforms without prior notice for reasons including, but not limited to, general maintenance or breach of terms.

Additional Terms of Service (TOS) specific to particular products or services (e.g., air tickets, holiday packages) will form an integral part of this Agreement. In case of a conflict between this Agreement and any TOS, the provisions of this Agreement shall prevail. Users must also adhere to the terms, guidelines, and operational policies of third-party service providers engaged through THPL.

Accessing Third-Party Accounts

Users opting for THPL’s Account Access services authorize THPL and its agents to access third-party platforms (e.g., banks, payment gateways) to retrieve relevant information on their behalf. Users are responsible for safeguarding their credentials and promptly reporting unauthorized access. THPL shall not bear liability for losses resulting from unauthorized account use.


Confidentiality

Information explicitly designated as confidential by THPL must not be disclosed by the User except as required by law or as necessary to fulfill the obligations under this Agreement. Breach of confidentiality by the User will result in immediate termination of services.


Website and Mobile App Usage

The use of THPL's website and mobile application is at the User's sole risk. Users must ensure that any products, services, or information available meet their requirements. Unauthorized reproduction, distribution, or modification of any content, software, or materials from THPL's platforms is strictly prohibited and may result in legal action. THPL reserves the right to amend, update, or remove content without prior notice.


User Accountability and Compliance

The User is solely responsible for verifying the accuracy of transaction details and complying with all applicable local, national, and international laws relevant to their jurisdiction. THPL bears no liability for screening, validating, or ensuring the legality of transactions facilitated through its platforms.


Insurance

Unless explicitly included in THPL’s services, securing insurance coverage is the User’s responsibility. THPL is not liable for claims related to inadequate or absent insurance. Where insurance is provided, claims must be made directly to the respective insurance provider under their terms.


Force Majeure

THPL shall not be liable for failure to perform any of its obligations under this Agreement due to unforeseen circumstances beyond its control, including, but not limited to, natural disasters, strikes, government actions, technical failures, or service operator disruptions. In such cases, THPL will attempt to provide alternatives or refunds, subject to applicable service charges and third-party refunds.


Liability Limitation

Under no circumstances shall THPL or its affiliates be held liable for indirect, incidental, consequential, or punitive damages, including, but not limited to, loss of data, profits, or business, arising from the use of its services or platforms. THPL’s maximum liability shall be limited to the total amount paid by the User for the affected service, excluding applicable fees or charges.


Proprietary Rights

All content, including but not limited to text, graphics, audio, video, and software, provided by THPL is protected by copyright, trademark, and other intellectual property laws. Users may not reproduce, distribute, or modify this content without express written consent from THPL.


Visa Obligations

Visa compliance is the sole responsibility of the User. THPL disclaims liability for any travel disruptions or refunds arising from failure to secure the requisite travel documents.


Indemnification

The User agrees to indemnify and hold harmless THPL, its affiliates, and agents from any claims, losses, or liabilities arising from violations of this Agreement or misuse of its services.


Right to Refuse and Cancel Services

THPL reserves the right to refuse or cancel services at its discretion if fraudulent, unauthorized, or inaccurate information is detected. THPL shall not be liable for any loss resulting from such cancellations.


Severability Clause

If any provision of this Agreement is deemed unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.


Relationship

This Agreement does not create a partnership, joint venture, or agency relationship between the User and THPL.


Governing Law and Jurisdiction

This Agreement is governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Chennai, India.


Modification of Terms

THPL reserves the right to modify this Agreement and its terms at any time without prior notice. Users are encouraged to review the terms periodically for updates.


Usage of Customer Media

By sharing photos or videos during or after a trip, Users consent to their use on Tripiy’s social media. Requests for removal must be sent to help@Tripiy.com or happiness@Tripiy.com and will be honored promptly.


Cancellation Policy – Terms & Conditions

General Provisions

  1. This Cancellation Policy applies to all vacation packages curated by Tripiy Holidays Pvt. Ltd. (hereinafter referred to as "Tripiy") effective from 01 September 2019.
  2. Refunds for cancellations will be processed within 90 working days from the date of cancellation or upon the receipt of refunds from the respective supplier(s), whichever is later. For cancellations made during a trip, refunds will be processed within 90 working days from the return date or upon receipt of refunds from supplier(s), whichever is later.
  3. Refund amounts are subject to changes based on fluctuations in international exchange rates, refunds received from suppliers, and payments made by customers to date. Any variations in refund amounts will be communicated to the customer by their designated account manager.

Flights

  1. Flights marked as “Non-Refundable” in the final travel vouchers will not be eligible for any refund.
  2. Flights marked as “Refundable” in the final travel vouchers will be refunded as per the terms detailed under the "Cancellation Policy" section of the product and the final itinerary emailed to the customer.
  3. Refund amounts for flights may vary due to international exchange rate fluctuations.
  4. Tripiy shall not be liable for disruptions such as grounded, canceled, or delayed flights. Customers must directly contact the respective airline for cancellations, and refunds will be processed based on the airline’s policies.
  5. Tripiy bears no liability for customers being denied boarding due to passport issues, including expired or damaged passports. It is the customer’s responsibility to ensure their passport has a minimum of one year of validity and is in good condition.
  6. Customers are expected to arrive at the airport at least two hours prior to boarding time. Tripiy is not liable for refunds in cases where customers miss their flights due to late arrival unless airport transfers were explicitly arranged by Tripiy.
  7. Where Tripiy provides airport transfers, it is not liable for flight cancellations caused by unforeseen regional circumstances leading to delayed transfers.
  8. Details of baggage limitations (cabin and check-in) are included in the final travel vouchers. Additional fees for exceeding baggage limits must be paid directly to the airline at the time of check-in.
  9. Customers using carriers with mandatory web check-in policies (e.g., Ryanair, Vueling, Volotea) must comply to avoid additional airport charges. Tripiy will not refund such charges.
  10. Meal preferences requested by customers will be shared with the airline, but availability and quality of meals are the airline's responsibility, not Tripiy’s.

Hotels

  1. Hotels marked as “Non-Refundable” in the final travel vouchers are not eligible for refunds.
  2. Refundable hotels will be subject to the terms outlined in the "Cancellation Policy" section of the product and the final itinerary shared via email.
  3. Refund amounts for hotels may vary due to international exchange rate fluctuations.
  4. Tripiy is not responsible for the behavior of hotel staff, the cleanliness of accommodations, or the quality of services provided by hotels.
  5. Costs related to room upgrades or additional amenities during the trip will be borne solely by the customer.
  6. Changes to hotel bookings during the trip will incur a 100% cancellation fee for the originally booked hotels.
  7. Requests for early check-in or late check-out are at the discretion of the hotel. Tripiy will not process cancellations due to non-availability of such requests.

Activities

  1. Activities marked as “Non-Refundable” in the final travel vouchers are not eligible for refunds.
  2. Refundable activities will be subject to the terms outlined in the "Cancellation Policy" section of the product and the final itinerary shared via email.
  3. Refund amounts for activities may vary due to international exchange rate fluctuations.

Transfers

  1. Refunds for transfers will be processed as per the details outlined in the "Cancellation Policy" section of the product and the final itinerary shared via email.
  2. Refund amounts for transfers may vary due to international exchange rate fluctuations.

Visa & Insurance

  1. Tripiy serves as a facilitator for Visa applications, providing guidance on formalities and documentation. However, the decision to grant or reject a Visa rests solely with the respective embassy or consulate. Visa fees are non-refundable in the event of rejection.
  2. Tripiy shall not be held liable for changes to Visa formalities introduced by embassies during the application process.
  3. Insurance services, once applied, are non-refundable and incur a 100% cancellation fee.
